U.S. Rep Chip Roy has filed a resolution urging Vice President Kamala Harris to assemble the Cabinet and declare President Joe Biden unfit as Commander-in-Chief.

The resolution, filed on Friday, comes after President Biden’s shaky performance during the presidential debate with former President Donald Trump on Thursday night. Biden appeared to struggle cognitively, alarming Democrats and Republicans alike who questioned his ability to perform the role of President and Commander in Chief.

“I put forth a resolution calling upon the Vice President to immediately use her powers under section 4 of the 25th Amendment to convene and mobilize the principal officers of the Cabinet to declare the President of the United States is unable to successfully discharge the duties and powers of his office,” Roy said in Friday’s press release.

When a president is unable to fulfill the duties and obligations of office, section 4 of the 25th Amendment, ratified in 1967, triggers the process that enables the vice president to become acting president.

In an interview with conservative political commentator Glenn Beck posted on X, Roy commented that people have known about Biden’s decline. He told Beck that “those of us who follow politics have known that President Biden has been diminishing, that he has been demonstrating his clear incapacity and inability to carry out the powers and duties of the office. I think last night it was on full display in a way that was much more apparent.”

Roy characterized Biden’s performance as “a clear demonstration to our enemies,” which resulted in “a weakened and endangered American people.”

“We have 7 months at least under [Biden] and a potential of longer if you let him run for reelection and he happens to win,” he added. “We should right now focus on the fact that he is unable to faithfully discharge the duties that he has been empowered to do as Commander in Chief.”

After the debate, Biden-supporter and CNN political commentator Van Jones said, “I love Joe Biden. But tonight’s debate hurt.”

Amid speculation of possible replacements for President Biden, The New York Times reported staunch allies, such as MSNBC host Joe Scarborough, are calling for President Biden to consider stepping down after his appearance in Thursday’s debate.

There has been much speculation about President Biden’s cognitive abilities for some time. In 2022, Texas Scorecard asked readers if they thought Biden was mentally fit to serve as President of the United States. Responses show that even at that time, readers were concerned about Biden’s mental state.
