A coalition of 16 states led by Texas Attorney General Ken Paxton have won a lawsuit against the Biden-Harris administration, halting a federal parole program aimed at allowing 1.3 million illegal aliens to remain in the United States. 

Known as “parole in place,” the Biden-Harris administration rule unveiled earlier this year gave an avenue for illegal aliens in the country for 10 or more years to receive a grant of parole if the alien is married to a U.S. citizen. 

In August, Paxton—represented by America First Legal—sued the Biden-Harris administration claiming that the rule would change the residency status of certain illegal aliens and permit them to remain in the country indefinitely. The lawsuit alleged that this circumvented congressional authority and violated federal law. 

Out of the 1.3 million illegal aliens paroled under the scheme, the Department of Homeland Security program would benefit 200,000 illegal aliens residing in Texas. 

The judgment made by U.S. District Judge J. Campbell Barker in the Eastern District of Texas declared that DHS lacked statutory authority to grant parole “in place” to illegal aliens. 

“That agency action is hereby set aside and vacated,” wrote Barker.

Gene Hamilton, AFL Executive Director, celebrated the win saying the ruling has stopped the “largest administrative amnesty in American history.”

“Since day one, the Biden-Harris Administration has dedicated itself to the decimation of our immigration system and the erasure of our borders. Time and again, the States stood up. And today, the great State of Texas and the courageous Ken Paxton, alongside a coalition of other brave Attorneys General, succeeded in stopping an illegal program that would have provided amnesty to hundreds of thousands of illegal aliens and paved the path for the largest administrative amnesty in American history,” said Hamilton.

 Paxton also released a statement saying if the scheme would have continued, millions more illegal aliens would have been rewarded for breaking into the country.

“Once again we have stopped the Biden-Harris Administration’s radical attempts to destroy America’s borders and undermine the rule of law,” said Paxton. “This unlawful parole scheme would have rewarded more than 1 million illegal aliens with citizenship and incentivized millions more to break into our country. I look forward to the day when the federal government starts following the law again.” 

The states that joined Texas are Alabama, Arkansas, Florida, Georgia, Idaho, Iowa, Kansas, Louisiana, Missouri, North Dakota, Ohio, South Carolina, South Dakota, Tennessee, and Wyoming.
