Attorney General Ken Paxton has successfully blocked the Biden administration from disposing of border wall materials.

Earlier this month, reports from The Daily Wire revealed that the Biden administration was attempting to auction off up to half a mile of border wall per day, with a starting bid of $5. Following the news, Paxton filed a motion with a federal district court to halt the sale of border wall segments. 

During a court hearing on Friday, the Biden administration agreed to an order preventing them from disposing of any more border wall materials over the next 30 days, allowing incoming President Donald Trump to use the materials as he wants.

Additionally, the court made clear that Texas is entitled to documentation proving that the Biden administration has not violated an injunction secured by Paxton in May. The injunction forced the federal government to spend statutorily obligated funds on border wall construction after the federal government attempted to redirect the money illegally. 

Paxton stated that if the administration disposed of border wall materials purchased with the funds obligated to its construction or if the U.S. Department of Justice made misrepresentations about the materials being auctioned, they could be held in contempt of court—a penalty for disobeying an official court proceeding or order.

“We have successfully blocked the Biden Administration from disposing of any further border wall materials before President Trump takes office,” said Paxton. 

“This follows our major victory forcing Biden to build the wall, and we will hold his Administration accountable for illegally subverting our Nation’s border security until their very last day in power, especially where their actions are clearly motivated by a desire to thwart President-elect Trump’s immigration agenda.”
