A state agency is asking the Texas Attorney General’s Office for permission to withhold investigative reports about, and complaints against, a government district.
On January 19, Texas Scorecard sent a Public Information Act request for these records to the Texas Commission on Environmental Quality regarding Water Control and Improvement District No. 92 in northern Harris County.
In response to Texas Scorecard’s request, TCEQ provided seven investigative reports, ranging from 2019 to 2025, and one February 2024 letter to WCID No. 92 board President Donald Roberts following up on an “outstanding alleged violation.”
Roberts resigned in January 2026.
While it provided these records, TCEQ is withholding others, pending a decision from Attorney General Ken Paxton’s office.
The state agency’s February 3rd letter to Paxton asked for a decision on the “confidentiality” of the withheld records. TCEQ claimed fifteen exceptions to the requirement to release responsive documents in state law, including litigation, law enforcement, information related to competition or bidding, commercial, financial, or proprietary information, attorney-client privilege, and the Texas Homeland Security Act.
As previously reported, citizen Barbara Rivera has alleged that WCID No. 92 is hiding financial records from her after her investigation uncovered questionable district spending.
