Members of the Texas Legislature have officially registered their opposition to proposals from national Democrats to pack the United States Supreme Court.

On Wednesday, the Texas House heard and passed Senate Concurrent Resolution 41, which urges Congress to reject proposals to expand the number of seats on the U.S. Supreme Court. The resolution passed the House on a partisan 77-64 vote.

State Rep. Mayes Middleton (R–Wallisville), the House sponsor of the resolution, emphasized that keeping the Supreme Court at nine justices is a tradition going back to 1869 that should not be destroyed by political operatives. 

“The Supreme Court has been this way for 152 years. Let’s keep it that way,” said Middleton.

The resolution urges Congress to not only avoid court packing, but also to ratify a new “Keep Nine” constitutional amendment to ensure the Supreme Court would remain at nine justices forever. 

Copies are to be sent to the president of the United States, the president of the Senate, the speaker of the House, and members of the Texas congressional delegation.
