Attorney General Ken Paxton has filed a motion with a federal district court to prevent the Biden administration from selling sections of the border wall. 

According to recent reports, the Biden administration has allegedly been attempting to auction off up to half a mile of border wall per day. According to the Daily Wire’s investigation, the federal government was listing entire wall panel sections on an auctioning site for a starting bid of $5.

In May, Paxton secured a final victory, forcing the Biden administration to spend statutorily obligated funds on border wall construction after the federal government attempted to redirect the money illegally. 

Paxton says the Biden administration would violate a federal court order if it sold sections of the wall purchased with funds to secure the border.

Because the administration is attempting to auction off the materials, he has filed a motion with the U.S. District Court of the Southern District of Texas to halt the illegal sale. 

Paxton, along with Missouri Attorney General Andrew Bailey and Texas General Land Commissioner Dawn Buckingham, is asking the court for a status conference—“a warranted enforcement mechanism to determine whether Defendants are circumventing this Court’s Final Judgment and Permanent Injunction by selling off border wall materials that were purchased with funds that the Court has said may only be used for the ‘construction of physical barriers.’”

The Biden administration is asked to provide the “origin, manufacture date, original funding source, and other identifying information regarding each section of border wall, and other items being remitted for auction.”

“The Biden Administration cannot auction off sections of the border wall. If these reports are true, the Biden Administration is violating a federal court order,” said Paxton. “Texas is going to court to prevent any border security materials from being unlawfully sold and to find out the truth about what the federal government may be doing to subvert border wall construction. President Trump has an overwhelming mandate from the American people to build the wall, and I will do everything in my power to prevent any acts of sabotage by the outgoing administration.”  

Buckingham also commented on the motion, saying that the latest attempt to sell border materials is a “disregard for the safety of Texas and American families.”

The Biden Administration’s latest attempt to block Texas and President-Elect Donald Trump’s efforts to secure the southern border is downright shameful and demonstrates a continued pattern of disregard for the safety of Texas and American families in favor of increasingly disastrous open border policies.

“I made a promise to use every tool at my disposal from the GLO to secure our border and protect Texans. That is why I have offered state leaders and President-Elect Donald Trump the opportunity to store any wall panels his incoming administration may acquire on state land,” said Buckingham. “I will never give up the fight to secure our porous southern border and protect our sons and daughters from violent, criminal illegal immigrants.”
