An illegal alien charged with unlawful re-entry has been convicted and sentenced following a two-day trial in May.
A jury in the Southern District of Texas found Eduardo Aguilera-Gallardo guilty on the single count of illegal re-entry into the United States.
U.S. Judge Sim Lake ordered that Aguilera-Gallardo serve four years in federal prison, after which he will face deportation proceedings.
Testimony during the trial revealed that Aguilera-Gallardo was removed from the country after losing the lawful permanent resident status he received in 2001.
An immigration judge ordered that he be removed to Mexico in 2024. Aguilera-Gallardo appealed the ruling, but it was dismissed in July 2024, and he was deported in 2025.
Following his removal, law enforcement officers found him in Houston in April 2025 without authorization to be in the U.S.
The court also heard about Aguilera-Gallardo’s extensive past criminal history, including convictions of possession of controlled substances, theft, and reckless driving, and noted that his prior sentences “were not enough of a deterrent for his continued criminal conduct.”
He will remain in custody pending transfer to a federal prison.
The case is part of Operation Take Back America, a Justice Department initiative aimed at combating illegal immigration, eliminating cartels and transnational criminal organizations, and protecting communities from violent crime.
