Laredo Customs and Border Protection officers arrested an illegal alien with an outstanding felony warrant for sexual assault on a child with a deadly weapon.
On September 29, Juan Elizondo Delgado, a Mexican citizen, attempted to exit the U.S. on a commercial bus leaving for Mexico.
Both the bus and Delgado were referred for a secondary inspection at the Juarez-Lincoln Bridge in Laredo, Texas.
CBP officers found that Delgado was an illegal alien not possessing documentation to enter or remain in the U.S.
Officers conducted further biometric verification through law enforcement databases. The search revealed that Delgado had an outstanding felony warrant for sexual assault against a child under 14 with a deadly weapon.
The Reno Police Department in Nevada had issued the felony warrant.
Once CBP officers confirmed the warrant, they turned Delgado over to Webb County sheriff’s deputies for transportation to the Webb County jail for adjudication of the warrant.
“CBP officers’ continued vigilance at our ports of entry contributed to this significant apprehension,” said Alberto Flores, port director, Laredo Port of Entry. “This arrest reinforces CBP’s dedication to working alongside local agencies to ensure public safety.”
Jail records show Delgado was booked on September 29 on one count of sexual assault of a child and two counts of indecency with a child by sexual conduct. He was released October 14 on personal recognizance bonds of $10,000 per charge.
Felony personal recognizance bonds are usually discretionary and difficult to obtain, with magistrates often considering factors such as child molestation, immigration status, flight risk, violence, and criminal record.
However, while the Texas Code of Criminal Procedure generally prohibits releasing defendants charged with sexual assault on a personal bond, an exception requires personal-bond release when the county where the alleged offense occurred fails to demand and take custody of an eligible defendant before the 11th day after the defendant is committed to jail.
