The Biden-Harris administration conceded in a lawsuit Texas filed against a rule that would have overridden state laws giving parents the right to consent to their children’s medical care.
The lawsuit challenged the U.S. Department of Health and Human Services rule requiring healthcare providers to give contraceptives to minors without parental consent as a condition for receiving federal funding under Title X of the Public Health Service Act.
The rule violated state parental consent laws and legal precedent that held Title X rules must comply with state regulations, explained Attorney General Ken Paxton.
After the HHS backed down and decided not to enforce the challenged regulation in Texas, Paxton filed a notice of dismissal.
“The Biden-Harris Administration threatened to withhold taxpayer money to coerce healthcare providers into violating state law and providing contraceptives to children without any parental oversight,” said Paxton. “We won a complete and total victory, forcing the outgoing administration to abandon its illegal agenda.”
This dismissal means healthcare providers in Texas will continue following state parental consent laws without the threat of losing Title X funding.
