A new memorandum issued by the U.S. Department of Justice orders local and state governments to comply with executive immigration initiatives.
The memo issued Tuesday comes from the Office of the Deputy U.S. Attorney General.
Interim Deputy AG Emil Bove informed employees that they are responsible for assisting in carrying out policy changes regarding charging, sentencing, and immigration enforcement.
“Following President Trump’s second inauguration yesterday, I write regarding interim decisions and policy changes pending confirmation of the Attorney General. These interim changes are necessary as an initial response to Executive Orders that President Trump issued yesterday,” reads the memo.
Bove lays out the three threats facing America as a result of the Biden administration’s failed border policies: cartels and transnational criminal organizations like Tren de Aragua and the MS-13 gang, escalating violent crimes by cartel members and other illegal aliens, and the fentanyl crisis.
“The Justice Department must, and will, work to eradicate these threats. Indeed, it is the responsibility of the Justice Department to defend the Constitution and, accordingly, to lawfully execute the policies that the American people elected President Trump to implement,” the memo continues. “The Justice Department’s responsibility, proudly shouldered by each of its employees, includes aggressive enforcement of laws enacted by Congress, as well as vigorous defense of the President’s actions on behalf of the United States against legal challenges.”
Additionally the memo also warns that anyone who interferes with the DOJ’s efforts to eradicate the threats will be faced with legal action.
Referencing the Supremacy Clause, the DOJ states that it requires “state and local actors to comply with the Executive Branch’s immigration enforcement initiatives.”
Federal law prohibits state and local actors from resisting, obstructing, and otherwise failing to comply with lawful immigration-related commands and requests … The U.S. Attorney’s Offices and litigating components of the Department of Justice shall investigate incidents involving any such misconduct for potential prosecution, including for obstructing federal functions in violation of 18 U.S.C. § 371, and violations of other statutes, such as 8 U.S.C. §§ 1324, 1373.
According to the memo, if there are laws and actions that threaten to impede President Donald Trump’s immigration initiatives—like prohibiting disclosures of information to federal authorities engaged in immigration-enforcement activities—the Office of the Deputy Attorney General will identify state and local laws, policies, and activities that are inconsistent with Trump’s immigration initiatives and take legal action.
Tarrant County Judge Tim O’Hare posted to X expressing his support for Trump’s immigration agenda and willingness to assist Trump’s efforts.

Tarrant County is committed to upholding the rule of law and ensuring the safety and security of its residents,” wrote O’Hare. “Judge O’Hare welcomes the President’s efforts and commitment to crack down on the failed immigration policies costing taxpayers billions annually. Tarrant County will fully and unequivocally support law and order and the enforcement of American immigration laws.”
