State Rep. Steve Toth (R-Conroe) has urged Gov. Greg Abbott and Attorney General Ken Paxton to intervene in the Texas Medical Board’s proceedings against Dr. Mary Talley Bowden.
In an open letter posted on X earlier this week, Toth called TMB’s investigation and legal proceedings against Bowden illegal and intended to intimidate doctors going forward. State Rep. Tony Tinderholt (R-Arlington) joined Toth in his call.
Tinderholt said he hopes that Paxton and Abbott will investigate and hold the Texas Medical Board accountable for “their abuse of a medical professional who saved lives!” He added, “She [Bowden] isn’t the only one the TMB abused and threatened! What a disgraceful time for the TMB!”
Dr. Bowden, an Ear, Nose, and Throat specialist, has garnered national attention for successfully treating over 6,000 COVID-19 patients without a single death. She’s also become a key figure in the fight for medical freedom.
Despite her impressive record, her medical license is in jeopardy, thanks to TMB’s pursuit of formal complaints. The complaint alleges unprofessional conduct and violations of the standard of care during her treatment of an ICU patient in a Texas hospital.
One complaint, filed in April 2023, alleges that Dr. Bowden prescribed medication to a hospitalized COVID-19 patient in Fort Worth without having a prior physician-patient relationship with the patient. It also claims that she didn’t establish a medical relationship before prescribing him medication and that she sent a “delegate” to administer the drug at the hospital despite having no privileges and no prior relationship with the patient.
Dr. Bowden has maintained her innocence, stating that she is the victim of vindictive bureaucrats and that her due process rights have been violated—a claim that Toth echoed in his letter to Abbott and Paxton.
On the eve of an administrative hearing set for Monday, proceedings were again delayed until September or October. The process has taken more than two and a half years to date.
The legislature passed Senate Bill 773 in 2023 to protect access to investigational medicines and specifically updated the state law to forbid action against physicians based solely on recommended treatments that may be deemed controversial.
