Attorney General Ken Paxton is investigating the Austin Independent School District over possible violations of state law regarding women’s privacy in intimate spaces.

A report was made by a concerned citizen alleging that Austin ISD has allowed men into women-only areas inside its schools.

If true, it would violate Senate Bill 8, known as the Women’s Privacy Act, which prohibits men from using private spaces—such as restrooms and locker rooms—in state agencies, local governments, and political subdivisions intended for use by women.

“I will work tirelessly to hold Austin ISD accountable if it does not stop its unlawful, woke policy of allowing men to invade women’s spaces,” stated Paxton. “The law is clear that political subdivisions in Texas must not allow biological men to use girls’ bathrooms and locker rooms, yet Austin ISD has intentionally chosen to do that in violation of S.B. 8.”

“I will explore every legal avenue to protect our students and ensure that women’s spaces are protected from mentally ill men who want to pretend they’re girls.”

According to state law, the Office of the Attorney General is required to first send out the notice before filing a lawsuit. The district now has until March 21 to fix the issue before Paxton can file suit.

In Paxton’s warning, there is a $5,000-per-day penalty if the violation continues.

Paxton is also investigating Austin ISD over student participation in walkouts to protest the operations of U.S. Immigration and Customs Enforcement. 

Austin ISD is currently on Spring Break and did not respond to Texas Scorecard’s request for comment before publication.
