Democrat U.S. Senate nominee James Talarico is being accused of breaking election law by using his mother’s home address during his 2022 campaign for Texas House District 50.
“It is absolutely disgusting that James Talarico used his mother’s address to not only commit voter fraud, but also to defraud his entire constituency, all so he could run in a safe Democrat seat,” Paxton campaign Spokeswoman Madison Cercy said.
A new report from The Federalist details Talarico’s claim that he was “gerrymandered” out of the House District 52 seat he held during the October 2021 redistricting process. While Talarico was a Round Rock resident at the time, he announced in a tweet his intention to run for the seat in House District 50 in neighboring Travis County instead.
“Republicans have gerrymandered me out of my district…I’m grateful to everyone urging me to move back to HD50 – where I grew up – to run for the seat being vacated by my friend Rep Israel. I’m in,” Talarico posted at the time.
The report explains that Talarico registered to vote using his mother’s address in Austin. According to the report, no evidence has emerged to indicate that Talarico resided at the address when he registered.
The Texas Constitution requires that an individual elected to the Texas House “shall have been a resident of this State two years next preceding his election, the last year thereof a resident of the district for which he shall be chosen. …”
Because Talarico was first elected to House District 50 for the first time on November 8, 2022, and did not become a resident of that district until that year, Paxton’s campaign argues that he failed to meet this constitutional qualification.
Cercy said, “He is a lying politician who has been deceiving voters throughout his time in office, so it should come as no shock that he continues his flip-flop tour across the state of Texas.”
Talarico has also accused Paxton of improperly voting from his Collin County home address, arguing that although Paxton is separated from his wife, Angela, he has continued to vote using the address they once shared.
“It shouldn’t surprise anyone that the guy who thinks illegals should vote has been caught red handed committing election fraud. Fraudsters like James Talarico are exactly why Attorney General Ken Paxton and President Trump are fighting for the SAVE America Act to secure our elections from liberal shenanigans once and for all,” said RNC Spokesman Zach Kraft.
Talarico’s campaign did not respond to a request for comment.
