A now-former Texas teacher was arrested and charged with aggravated sexual assault of a child, along with nine other sex crimes against a student, more than two years after he was allowed to resign while under investigation for the allegations.
David Rios, 47, taught law enforcement at Samuel Clemens High School in Schertz-Cibolo-Universal City Independent School District, located northeast of San Antonio.
Rios was arrested October 18 in Guadalupe County and charged with 10 felony counts: one count of aggravated sexual assault of a child, four counts of sexual assault of a child, and five counts of improper relationship between educator and student.
The alleged offenses occurred from April through November 2021.
According to the Seguin Gazette, the indictment accuses Rios of sexually assaulting a female student under the age of 17 on five separate dates and also alleges he threatened the girl.
District officials placed Rios on administrative leave in February 2022 when the allegations arose, then allowed him to resign his position in April 2022 while the investigation continued.
Schertz-Cibolo-Universal City ISD Communications Director Deanna Jackson issued a statement regarding Rios’ arrest:
This arrest follows a thorough two-year investigation by the Schertz Police Department in response to an outcry from a former student. In February 2022, in addition to cooperating with the Schertz Police Department, SCUC ISD initiated its own internal investigation and immediately placed Mr. Rios on administrative leave.
Jackson said the district also reported Rios’ alleged misconduct to the State Board for Educator Certification, as required by law.
State records show Rios’ teaching certificate is under review by the Texas Education Agency’s Educator Investigations Division.
Rios was also a licensed police officer, but he reportedly resigned from the Bexar County Sheriff’s Office in September 2021.
The former teacher is being held in the Guadalupe County Jail on a $500,000 bond—$50,000 for each charge.
Rios is among dozens of Texas educators charged with sex crimes involving students and other children.
Another SCUC ISD educator, 42-year-old substitute teacher Yorllin Hernandez, was arrested twice in October and charged with assaulting students at Rose Garden Elementary and Jordan Intermediate.
