After her daughter was attacked in class, a mother was stunned by Mance Park Middle School’s initial response, which dismissed the assault and insisted her daughter was “perfectly fine.”

Hailey Evans, the mother of a 12-year-old student at Mance Park Middle School in Huntsville Independent School District, says her daughter was assaulted by a male student in the classroom last Friday.

The alleged attack was captured on video, which begins with the male student throwing the girl’s phone across the room and breaking it. When the girl confronts him, the video shows the male student throwing her to the ground, causing her head to hit a desk, then picking her up and throwing her down again. A teacher is seen standing nearby, seemingly doing nothing to intervene.

Evans first learned of the incident through an emotional phone call from her daughter, who told her what happened. However, when Evans contacted the school, she claims their initial response downplayed the situation.

According to Evans, “They were telling us that there was basically no incident. [My daughter] had not been assaulted … They said [my daughter] was perfectly fine.”

After receiving footage of the assault, along with photos of her daughter’s injuries, Evans rushed to the school. On her way there, the school nurse called to inform her that she believed her daughter had suffered a concussion and needed to be taken to the emergency room. Following a doctor’s examination, Evans learned that her daughter had sustained a severe concussion, which was documented as an assault injury, as well as bruising around her hips and stomach.

Evans then reached out to the school resource officer to inquire about pressing charges. She was told that charges couldn’t be filed because the incident was considered mutual combat.

FOX 26 reported that the officer was referencing Texas Penal Code Section 22.06, which states that “the victim’s effective consent or the actor’s reasonable belief that the victim consented” could potentially prevent any charges related to assault.

In a statement regarding the incident, Huntsville ISD wrote:

Huntsville ISD can confirm that an incident involving a physical altercation between two students occurred at Mance Park Middle School on Friday, February 14, 2025. Following a thorough investigation by Campus Administration and School Resource Officers, appropriate disciplinary actions will be taken in accordance with the district’s Student Code of Conduct. Due to student privacy laws, we cannot provide additional details about this specific incident. The safety and well-being of our students remain our top priority. Huntsville ISD is committed to maintaining a safe and respectful learning environment.

Meanwhile, another Houston-area school in Spring Branch ISD is investigating a separate assault that occurred on February 4 after a basketball game between Memorial and Stratford high schools. The initial attacker—allegedly a member of the Swearing Sailors, a group of students from Memorial High School—is said to have been masked during the incident. The victim of that assault was reportedly then attacked by up to 20 individuals.

During a school board meeting on Tuesday, the victim’s mother expressed concerns with the investigation, saying, “We are worried that with the passage of time this assault will slowly be swept under the rug, allowing these individuals to literally hide behind their masks.”
