Harris County District Attorney Kim Ogg has announced that she is seeking the death penalty for the two illegal aliens who have been charged with the murder of 12-year-old Jocelyn Nungaray.

“We will be filing notice with the state of Texas that we intend to seek the death penalty against Jocelyn’s murderers,” Ogg told Fox and Friends.

We are seeking death because we want the message out there that, regardless of who you are, but especially if you are illegally in this country, that you will face the same consequences as anyone else for murdering a child during the course of raping and kidnapping.

This comes after Ogg originally stated that she did not believe that the two illegal aliens, Franklin Pena and Johan Jose Martinez Rangle, would be eligible to receive the death penalty according to Texas law. However, forensic evidence has been found that shows the 12-year-old was sexually assaulted before she was killed, allowing Ogg to seek the death penalty.

Pena and Rangle, who are both alleged members of the Venezuelan Tren de Aragua gang, were arrested this past June soon after the murder occurred. Both had crossed illegally into the U.S. at El Paso, but on different dates.

Nungaray’s mother testified in September before the U.S. House Homeland Security Committee, stating, “Because of the Biden-Harris administration open border policies, catch and release, they were enrolled in the Alternatives to Detention program.”

“This meant that they were released into the United States. It was not even a full three weeks later that they would take my daughter Jocelyn Nungaray’s life.”

Rangel entered the country in March 2024, and Pena entered in May 2024.
