The U.S. Department of Justice has dropped its criminal case against a Texas Children’s Hospital doctor who blew the whistle on the hospital for continuing to administer cross-sex hormones to children.

In May 2023, Eithan Haim revealed that the hospital was continuing to administer cross-sex hormones and puberty blockers to minors despite its CEO announcing in March 2022 that that the practice would be terminated.

Federal agents visited Haim in June 2023, and Assistant U.S. Attorney Tina Ansari threatened him with prosecution. He was indicted this past summer, and the Biden administration subsequently unsealed the four-count indictment alleging that he used the hospital’s electronic system without authorization to obtain personal information including patient names, treatment codes, and the identities of attending physicians. 

Ansari was later recused from the case after it was found she had familial ties to Texas Children’s Hospital that created a conflict of interest.

In June, Attorney General Ken Paxton opened an investigation into the hospital for Medicare fraud after a second whistleblower came forward to claim that an alarming number of “transgender” teenage patients were under the care of two doctors named Roberts and Paul—who had allegedly been billing the state Medicaid program.

On Friday, Assistant U.S. Attorney John P. Pearson filed a motion with the U.S. District Court for the Southern District of Texas Houston Division to dismiss the criminal case.

Haim faced a four-count indictment, with maximum penalties including up to 10 years in federal prison and fines totaling $250,000.

Haim had posted to X on Wednesday that while President Donald Trump’s executive order to end the weaponization of the DOJ had taken effect, he was still being prosecuted.  

“The Trump administration took office a few days ago and issued an Executive Order to end the weaponization of the DOJ against its own citizens. But I can assure you that today that weaponization is just as alive as it was January 19th, 2025,” wrote Haim.

He promised to continue fighting the charges, stating, “We will fight in the public square. We will fight in the courtroom. We will fight in Congress. We will fight no matter what the cost.”
