U.S. Rep. Michael McCaul (R-10) announced that he and fellow lawmakers in Congress are demanding that the Biden-Harris administration stop violating federal immigration laws.
McCaul and 32 Republican lawmakers signed a letter to President Joe Biden and Vice President Kamala Harris demanding that federal immigration laws be enforced, specifically the DNA Fingerprint Act of 2005. This act authorizes federal government agencies to collect DNA samples from every immigrant who is arrested, charged, convicted, or detained.
For nearly ten years, according to the Office of Special Council, the Department of Homeland Security did not follow the law fully. After being notified by the OSC in 2019, the Trump Administration’s Department of Justice published a proposed rule to fix the non-compliance and it was finalized in 2020.
According to whistleblowers, the Biden-Harris Administration has still failed to fully implement the DNA Fingerprint Act.
“This blatant disregard for the law has been exacerbated by your administration’s failed border policies, which have precipitated an unprecedented explosion in nationwide encounters of illegal immigrants at our borders—over 10 million in just three-and-a-half years and this staggering sum doesn’t even account for the estimated 2 million that crossed and evaded apprehension,” the lawmakers wrote.
Whistleblowers have told the Senate that the failure to collect DNA from illegal aliens who cross the southern border has had serious repercussions that might have been avoided if the DNA Fingerprint Act were enforced. They also disclosed that during the first three-quarters of 2023 alone, only 36 percent of the 2.3 million encountered aliens had DNA samples collected.
“We cannot allow these failures to fully implement the DNA Fingerprint Act to occur any longer,” stated the signers.
“The American people deserve better, and their lives are at stake.”
Lawmakers from Texas that signed onto the letter include, U.S. Sen. Ted Cruz, U.S. Reps. Chip Roy, Lance Gooden, Troy Nehls, Wesley Hunt, and August Pfluger.
